Why does jail exist?
Prisons have four major purposes. These purposes are retribution, incapacitation, deterrence and rehabilitation. Retribution means punishment for crimes against society. Depriving criminals of their freedom is a way of making them pay a debt to society for their crimes.
Can 70 years old be imprisoned?
There is no rule on suspension of sentence by reason of seniority. There are some views that an accused, who is over 70 years of age, is entitled to post bail even though the crime is non-bailable for being punishable by reclusion perpetua because of the case of Enrile. This view has no jurisprudential basis.
