BILASPUR: In an order last week, Chhattisgarh high court said that a collector of a district is not empowered under rules to place a class II gazetted officer under suspension and institute a departmental enquiry against him.

➢ Gazetted Officer: An officer or public servant, who is appointed under the seal of the governor of the concerned state or by the president of India at national level, requires being listed in the Indian gazette or state government gazette to be considered a gazetted officer.

Can IAS be terminated?

Simply speaking, only the President of India can suspend or dismiss IAS officers after reviewing their case. The central government also has rights in this matter. If the suspension is to last for more than a year, the Central Review Committee has to be consulted.

Does PCS officer become DM?

The PCS officers had to go through various promotions to get promoted as an IAS officer. Due to a lack of recommendation, if he is not promoted to IAS rank then he will get a post correspondent to DM.

Can an IAS officer be transferred to another government agency?

No. He can only transfer him and that too on valid grounds and that action is subject to appeal against that order in the tribunal. In fact all civil services IAS, IFS, IRS and IPS etc holders has such immunity from the governments as our constitution makers has believed such a immunity will make them fearless and honest.
